The tang on rear of receiver that holds the stock thru-bolt could be bent.

Is the buttstock loose at all? Maybe the stock bolt just needs to be snugged up?

Of course it is not supposed to be like that. Is it the original stock or a refit stock? Does tightening the stock bolt slightly fix it? Yes, the tang could be bent a little if the gap is just at the top. People do that both on purpose (to change the drop or cast) and maybe it can happen by accident. I am guessing someone changed the stock and did not fit it well.
