Not worth my breath, you pay the tax.
I just bought another 2 1/2" Stainless Python from a gentleman in Lexington, KY. last Wednesday.
I sent him a certified check, he sent me the Pistol.
Yes, I have my own FFL.
NO SALES TAX WAS CHARGED OR PAID!

Since MI is not on that list, GB is not collecting sales tax, YET, it is likely a matter of time until they do.

The law has absolutely ZERO do do with where the SELLER lives, it's completely dependent on where the buyer lives.

If you sell on GB, you need to be aware of this, as GB is going to charge you, the seller, the sales tax NO MATTER WHAT if the buyer is in one of the states they collect for, and if you don't pass that on to the buyer, that's up to you, but you are going to eat it.

It is bound to happen....some uninformed Sellers that don't have the GB checkout setup are going to forget to collect the correct amount of sales tax on Buyers from applicable states, and will be in for a big surprise when they are billed for it from GB.

GB needs to either force Sellers to use the checkout process, or setup an automated email after each auction to each party informing them of the correct amount of sales tax to be collected. I think GB would have the info to make that calc for their Sellers and alert them so they don't get caught off-guard.

GB is so far behind the 8 ball on this it isn't even funny.

They still don't have a mechanism in place to find out how much in pending sales tax $ is owed to GB (and by extension the appropriate states), and they still haven't billed anyone for any of it so far, so you're going on 7 weeks worth of sales tax that sellers have collected but GB hasn't billed them for (but is keeping an unknown running tally for). I thought I'd read originally that they would add it to your monthly fee bill, but I'm reading now that that's not the case, it will be a separate bill, but they don't have a billing process in place yet to send you said bill, so the sales tax total will just keep accumulating until they do I guess.

I mean theoretically the seller should be setting that money aside to cover the bill, but how many sellers will actually know to do that (or are such low volume the surprise bill down the line won't hurt them). What will hurt is if you are a seller, sell a high end o/u for $10k, and didn't know the sale was subject to tax, so you didn't pass that a long to the buyer at the time of payment. Now months down the line you get a bill for 800 dollars from GB for the sales tax, it's basically going to be WAY too late to try and recoup that from the buyr.

I don't recall ever getting an email from GB notifying me of the sales tax change, I only noticed it because I saw a seller mention it on a listing. I'm sure there will be a BUNCH of casual sellers who are going to get stung by this, and it's mostly GBs fault.

Interestingly from what I can gather, at least for some states, an auction type site is only considered a marketplace facilitator if they actually process the payment between the buyer and seller (like ebay and amazon do). Meaning GB may not have even been subject to this if not for the FreedomCoin/BitRail cypto garbage they set up to facilitate payments that ultimately virtually nobody is going to use.
 
None of my purchases have ever been taxed from a seller. Different story if you pay thru gunbroker.
If you don't live the the states listed below, you don't get taxed, at least for now. I don't use GB checkout so I add the following:
Please remember, if you live in GA, IA, KY, ME, NE, NJ, and NV don’t forget to add the tax your state forces Gunbroker to collect. I am forced to pay it, so I will add it to your final price. Thank you.
 
The GunBroker.com MPF States

On April 1, 2021, GunBroker.com will be adding to the list of MPF states. In addition to the original 8 states (in Red and Bold) GunBroker.com will collect and remit sales tax for an additional 36 states based on the address where the item is delivered (Ship To address).
