Any lawyers out there. Would a lost will that turns up 8 yrs after death still be legal. The estate supposely was settled. Theres a little matter of $100,000 involved on a life insurance policy. Is there a statue of limitations on something like this. Any help appreciated. What would you do?? The insurance policy was paid to the wrong people.

Life insurance beneficiary designations are contractual, they go outside of probate or a will - was the named beneficiary deceased?!

Jay the Estate could have been the beneficiary then it would have went by will or probate.

    Don,

True. Unfortunately, naming an estate is too common, because its easy. But then sometimes one hears of the will getting "lost" just to take advantage of situations like this ... but I think we need a bit more info here to help understand the bigger picture -

    jd, come back...
