    From MORNING BRIEFING:

If the Republican Presidential Primary were held today, Mitt Romney would probably be the nominee. But this may be the high water mark for Mitt Romney after yesterday’s speech at the University of Michigan in which he gave a full throated defense of Romneycare.

In fact, in his Power Point presentation on slide 7, Mitt Romney defends the individual mandate as okay at the state level, but not at the federal level. That nuance may be constitutionally sound, but it sounds very much like Romney defending European socialized medicine at the state level.

A lot of people have waited on the sidelines hoping Romney would distance himself from Romneycare or apologize for it as Pawlenty has done with his global warming nonsense. Instead, Romney embraced his record.

The Wall Street Journal slammed Romney this week for the results of Massachusetts health care law. On the subject, Romney displays a "troubling failure of political understanding and principle" and he "still doesn't seem to understand how government works." In fact, the Journal concludes, "If he does not change his message, he might as well try to knock off Joe Biden and get on the Obama ticket." Ouch.

    From Erick Erickson:

A lot of conservatives beyond the Wall Street Journal's Editorial Board were disappointed by Mitt Romney yesterday. A lot of people who had decided he was not their cup of tea in 2008, decided he was the 2012 front runner and if only, if only he would distance himself from RomneyCare they'd be with him.

In fact, on a few occasions this year, I have sat in a room with big donors ready to go all in with Romney the moment he distanced himself from RomneyCare. Yesterday, instead of doing that, Romney embraced RomneyCare. He argued that what was good for Massachusetts is not good for America. He hit behind the tenth amendment and states rights to say it was okay for socialism in Massachusetts, but not everywhere else.

His ideas about ending ObamaCare were sound. They would probably work. But as the Democrats continue to build the case that ObamaCare is derived from RomneyCare, it will not be an easy case for Romney to make. Only Romney seems to believe he can make the case.

With a full embrace of RomneyCare and obfuscation behind states rights, Romney may have peaked yesterday. Time will tell, but the reaction of many conservatives who previously supported him and those leaning his way now, is decidedly hostile.
