Let's get the facts straight on Jimmy's supposed scam:

1.I sold the stock mistakenly to another party on this site ,thinking it
    it was Jimmy
2.I NEVER reveived a check from Jimmy
3.I offered to refund Jimmy's money if he emails me a copy of his cancelled
check regardless of who cashed it or the out of pocket cost to me!!
4.I accepted responsibility for the confusion and was completely honest
    with him.
5.Jimmy never emailed me directly,he only left messages in the message file
on trapshooters which slowed the communication process down.
6.Jimmy waited over two weeks before finally emailing me directly.
7.I've been selling on Ebay for 11 yrs and have 100% feedback...I deal
Honestly and made an honest mistake and accepted responsibility for it...
Jimmy cant accept that and has decided to "punish" me on Trapshooter's

Thx Bob, as a fellow Ebayer who also has 100% feedback for 10 years I completely understand your side. Accidents happen and mistakes are made in life. A mistake is all about what you do about it and you did ok by me. I don't know Jimmy but he certainly went about it different than I would have and I don't think that will earn him many points. Now it is all about how he handles it from here

Whaaaa Whaaaaa Poor ole Jimmmy didn't get to play with the ball at recess. Recess is over now, GET OVER IT, things happen.

If your this petty in life you don't deserve to steal the stock at that price anyway.

    Bob,

Thanks for clarifying. Your account is very plausible. Interesting how people make the worst assumptions, especially when they are pissed off.

Bob admitted an honest mistake was made. When you can produce a cancelled check you'll get your money back. Until then the check is lost in the mail. As others have so rightly said, "get over it".

    Jimmy,

I bet you spent your high school years stuffed inside a locker, upside down.

Get your popcorn boys! Looks like we've got another sucker on the line...

Jimmyc, I can see both sides of this unfortunate misunderstanding. Unless there's a clear communication between both the seller and the buyer as to who is who, shit happens. The person actually buying that stock may not even post here but read only communicate quicker. That regardless of you posting you'd buy it!! It's easy to see how Bob mistakenly sold the stock to someone else thinking it was you!! The sooner you understand how mistakes are made and not intentional the better off you'll be. Time to man up guy and accept this experience as a mistake. I'd wager you'll get your check back too?

Hap I got a pm from Robert with his address as well as him posting it was sold to jimmyc on the fs thread. That's what pissed me off. I'm ready to drop this because I guess I'll chalk this up to MAKING A DEAL with a screw up that can't keep his dealing straight.

Jimmyc, as I said, I honestly feel the guy made an honest mistaken assumption of who he was selling the stock to. It's very easy to do here and some guys are masters at beating one to the punch when it comes to buying out from under someone else. I feel for both of you guys!

I guess we can tell the character of both parties just buy the language and response of both parties.

Also posted in the original thread:

I agree with those who think this is much ado over very little nor do I agree that the circumstances, as posted here, justify calling Robertb291 a con artist or any of the other perjorative descriptions used above.

A mistake occurred, the buyer is not out any money that I can tell (check currently outstanding or not), nor is the buyer actually entitled to the rights to this stock...this is not a professional auction. Yes, fairness would call for the first buyer to get the product, but that this did not happen due to error does not mean that the buyer is injured or diminished from his original state. He just didn't get what he wanted...too bad.

I just recently bought a trigger group from a TS.com poster....the deal went smoothly, we both had each others full contact information, we spoke on the phone, and once again I concluded a pleasant deal with another very likable and honest shooter. This is the norm of my experience.
