    Could Your Shotgun Soon be Outlawed? Maybe, if the ATF Has its Way


    What’s the definition of a “shotgun?” According to Dictionary.com it’s “a smoothbore gun for firing small shot to kill birds and small quadrupeds, though often used with buckshot to kill larger animals.” For the gun enthusiasts, that’s only partly true, as there is also the option of using slugs. But what if there’s another addition that will soon be added to the definition? How about, illegal.

    In a series of fascinating, and eerie, posts over at the blog Beregond’s Bar (and linked on Redstate.com), author Tom pens a four-part series on the Bureau of Alcohol, Tobacco, and Firearms and their new campaign to change the definition of the term “shotgun.” A change, based on a recent study,* that could soon make some of them illegal.

    What most shotgunners don't realize is that their shotguns are already lumped in with machineguns, silencers, sawed-off shotguns, etc., because of the 1968 Gun Control Act. Any firearm with more than a half-inch bore is a "Destructive Device", lumped into the same category with bazookas, mortars, cannons, anti-tank guns, mines, and grenades.

    Why aren't they banned, then?<br>
    - Because they have a "sporting exemption".

    Can this "sporting exemption" be removed?<br>
    - Yes. Easily. At the whim of a bureaucrat.

    Are there any shotguns that will be exempt from this bureaucratic decree?<br>
    - Yes, the .410, because it is under .500" bore size. The 10, 12, 16, 20 and 28 gauges will be affected.

    Has this happened before?<br>
    - Yes. Several shotguns have already had their "sporting exemption" removed.

    Will this happen again?<br>
    - Yes, and in fact that is what's happening right now. Anyone with a shotgun that holds six shells may soon have a "Destructive Device", and you will have to register it as such. Assuming, of course, that the state or locality you live in allows ownership of Destructive Devices. If they don't, you'll have to either turn it in as contraband, or arrange to sell it out of the area or state. In the latter case, the market may be flooded and no one may want to buy your gun. No one will want to spend between $200 and $400 in tax stamps to buy a six shot capacity Mossberg.

    Can I take a shotgun declared as a Destructive Device across state lines?<br>
    - Maybe. If it is legal in the state you are taking it to, yes, provided you file a permission form with BATF prior to, and for the specific dates, of your visit. The almost worthless FOPA'86 that the NRA championed may provide a positive defense if a state you are traveling though arrests you and confiscates your gun. You may go broke from legal fees, but the positive defense aspect is there.

    not by any "American" government, it is hard to say what will happen with what we have running the US now. They have all been corrupted and bear no resemblance to a true American government.
