Acorn Defunding "unconstitutional"

    So now,,,,is this to mean that once congress funds something, the funding cannot be stopped???

    December 11, 2009. New York, NY - Today, U.S. District Judge Nina Gershon granted a preliminary injunction against the United States for unconstitutionally withholding funds from ACORN. In its decision, the court found that there is a likelihood the plaintiffs will be able to show that Congress’ targeted defunding of ACORN violates the Constitution’s prohibition against Bills of Attainder, legislative acts which single out a specific person or group for punishment.

    The Court’s ruling stated, “The plaintiffs have raised a fundamental issue of separation of powers. They have been singled out by Congress for punishment that directly and immediately affects their ability to continue to obtain federal funding, in the absence of any judicial, or administrative, process adjudicating guilt... The public will not suffer harm by allowing the plaintiffs to continue work on contracts duly awarded by federal agencies...”

    After the preliminary injunction was granted, Bertha Lewis, ACORN’s Executive Director, said, “The court's decision is a victory not only for the many dedicated citizens who work with ACORN to improve their communities and promote responsible lending and homeownership, but for the Constitution and the rights of all Americans.”

    According to Jules Lobel, CCR Vice-President and Cooperating Attorney: “This historic decision by the Court affirms the fundamental constitutional principle that the Congress cannot be judge, jury, and executioner.”

    CCR Legal Director Bill Quigley added, “This ruling protects not only ACORN but all other organizations or individuals that Congress unfairly targets. The clearly partisan push by the far right to punish those it politically disagrees with has ended here.”

    BTW,,,,the judge is a Clinton appointee,,,,Who said elections don't matter???

    I say taxation without representation is unconstitutional. When our elected officials are pre-empted from having descretion on how our tax money is spent then enough is enough. Time to start withholding federal taxes, enough of paying for all this BS.

    Ah, this is just basic contract law stuff. No biggie here. The contract was already awarded, work was performed, and the Eagle is going to make the contractually-specified payments according to schedule.


    What matters here is that ACORN is now politically radioactive, and nobody wants to get near them now. Their very name is synonymous with "crooks."


    There is NObody Obama won't throw overboard to assure his own re-election. ACORN is finding that out now, to their detriment. Become a liability to the Boss, and you are GONE like yesterday's paper.

    Where does it say in the Constitution that the government HAS to fund any organization. This left-wing judge is full of s__t!

    I see that mess as an extension of the "Sub Prime" mentality of American banking. The Big 3 were the perfect business examples of "sub prime borrowers" if there ever was one. Their business model was completely unsustainable. But the institutions who extended debt to them didn't care. They kept lending them money & buying their debt anyway, hoping to profit off the interest, secure in the belief that they wouldn't go completely bankrupt and if they did, bankruptcy court would put their interests foremost. It was a good deal for them and they made a lot of money off it over the years. So what happens when the value of the "underlying asset" plummets? Wall Street was never going to come out "whole" on that one. Obama just made them a little less "whole."

    I don't like how that went down, but in a bankruptcy, people lose money, and Obama probably figured he could re-arrange the secured bondholders' position in the payback line and not catch much flack for it. I guess when the judges, policymakers, and the main provider of financing are all from the same entity, that can happen.

    Not a proud day.
