PSSA v Valley

The Pennsylvania State Sportsmen’s Association (PSSA) commenced a lawsuit on March 28, 2011 against the Valley Gun & Country Club (VGCC) and its officers. After the filing of Preliminary Objections by the Defendant, VGCC, there were briefs filed by both parties and oral arguments were heard in front of Judge William Harvey Wiest in the Court of Common Pleas of Northumberland County, PA on October 4, 2011

On February 3, 2012 Judge Wiest issued his Order refusing to dismiss the lawsuit and ruled that the PSSA has stated a meritorious claim against VGCC and its officers.

Now with the Order issued, the lawsuit can move forward to the discovery phase in preparation for trial. When asked about the Order, PSSA President, Michael Schuler, indicated that he was “certainly pleased”.

“We would never have brought the lawsuit” said Mr. Schuler, “if we did not believe it to have merit. The PSSA feels vindicated that the court agrees with us”. Mr. Schuler further expressed his hope that after this ruling the VGCC will cease this time-consuming and expensive litigation and work with the PSSA to promptly fulfill the terms of the Agreement the parties signed in 1995. “That”, said Mr. Schuler, “will benefit everyone, not just the parties to the lawsuit, but the entire community”.
