In Plain English: The Affordable Care Act, including its individual mandate that virtually all Americans buy health insurance, is constitutional. There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power. That is all that matters. Because the mandate survives, the Court did not need to decide what other parts of the statute were constitutional, except for a provision that required states to comply with new eligibility requirements for Medicaid or risk losing their funding. On that question, the Court held that the provision is constitutional as long as states would only lose new funds if they didn't comply with the new requirements, rather than all of their funding.

Now it is getting more confusing with more reporting. If some states opt out, those people in those states would not be covered under Medicare, then they said Medicaid, instead of Medicare.
We may not know what the decision really is for weeks or days.
The key comment on salvaging the Medicaid expansion is this (from Roberts): "Nothing in our opinion precludes Congress from offering funds under the ACA to expand the availability of health care, and requiring that states accepting such funds comply with the conditions on their use. What Congress is not free to do is to penalize States that choose not to participate in that new program by taking away their existing Medicaid funding." (p. 55)

It's a victory for the Left regardless of how the mandate/tax thing is spun
This is just like the liberal newpapers, be the first to report something even if its wrong.
This will give the Left a bunch of momentum moving towards November. Obama will be hammered on the economy but will fire back that he "passed affordable care for all Americans".
Now our only shot if for the economy to stay stagnant. That's hard to say or imagine but it's really the only shot at not having him for another 4 years.

The court ruled that the mandate is unconstitutional under the Constitution's commerce clause, but it can stay as part of Congress's power under a taxing clause. The court said that the government will be allowed to tax people for not having health insurance.

Does Congress have to go back and rewrite the bill to be able to tax the uninsured or with the decision is it written into law that way?
This means that that the tea party needs to rise up again and clean house in congress and the white house so we can repeal and start over with workable healthcare. The question I have is how will they collect the tax when 50% of the people do not pay taxes and get no refund?

I'm thinking there may be a reason Justice Roberts voted this way. It may make it easier for congress to undo Obamacare at the legislative level if it's power is based on a tax. Congress can also vote to NOT tax.

It is still a case where the government is taking your property (money) disguised as a tax, if you do not do what they say.
Tme to dump the "Commerce Clause" and define further the powers of the Congress in it's ability to tax.
the fact is that health care costs have been on the rise since the 1970, because the government has seen fit to regulate and administer it and it will only get worse.
States will opt out of expanded Medicaid, because they will not be able to afford it, more poor people will have have health insurance, perhaps they will move from those States that don't to those that do.
If you think the guy runs roughshod now wait until he is near the end of his term in office whether it be this term or the next.

And vote in off year elections. The people you put in Congress and the Senate are more important than the POTUS.
That last sentence is absolutely true, Rick. The President does not really have that much power. If you have the majority of the Congress and Senate voting to approve a bill, it kind of makes the President helpless to veto, unless the opposing party controls both. Then maybe that option may make sense. That is why there needs to be compromise on these bills, to make it good for both parties, then if the President vetos the bill he looks like a schmuck.

Almost nothing you just wrote is correct.
1. Most legislation requires a simple majority (of a quorum) to pass the House or Senate. It must pass both houses to be enacted.
2. A president can veto ANY piece of legislation - even if it passed by a unanimous vote in both houses of Congress.
3. If a president vetos a bill, Congress may attempt to override the veto. A successful override requires a two-thirds majority in the House AND Senate.
4. The opposition party can control the House AND Senate and still fail to override a veto.
The president's party only needs one third plus one vote of EITHER the House or Senate to kill an override attempt. For example, thirty-four (34) Senators would do it.
Here's why the details matter today...
Boner, Cantor and various other House GOP leaders have vowed repeal obummercare as soon as the July recess ends. Let's assume they're successful.
The Senate has 51 lib/dem members. In addition there are two 'independents' that ALWAYS vote with the dems. A repeal of obummercare will never see the light of day in the Senate between now and November.
Now fast forward to November 7, 2012 - the day after the election. Let's assume the House passed an act to repeal obummercare. Let's further assume that as of November 7th, the GOP has a Senate majority and immediately votes to repeal obummercare.
None of it means diddly squat if obummer is reelected. Neither the House or Senate will have anywhere near enough votes to override the inevitable veto.
